Terms of use

DRAFT PENDING LEGAL REVIEW. This text describes accurately what the app actually does, but it has not been reviewed by a lawyer and should not be taken as the final document. If you are reading this in a published release, tell us.

These terms are the agreement between you and whoever operates Vexxy ("we"). Creating an account means accepting them. If you disagree with any of it, don't use the app.

Who can use Vexxy

You must be 18 or older. This isn't a checkbox: creating a profile asks for your date of birth and the server rejects anything under 18. Faking your age is grounds for immediate removal without warning.

You need a mobile number that can receive SMS. One account per number.

You can't use Vexxy if we've removed you before, and you can't create a new account to get around a removal.

Your account is yours

You're responsible for what happens from your account and for access to your phone. Don't share it or hand it over.

If you lose access to the number, you lose access to the account: we don't keep any other data that would let us identify you reliably. That's the consequence of not asking you for more than we need.

How to behave here

The House rules are part of these terms. They're written in plain language and they're short on purpose; read them, because they're what actually gets applied when someone reports something.

Short version: no nudity or sexually explicit content, no pushing after a "no", no lying about who you are, no minors, no selling or promoting, no hate or threats, no other people's personal information.

What you upload

What you post stays yours. You give us permission to store it, process it and show it inside the app to the people it's meant for, and nothing else. We don't use your photos in advertising, we don't hand them to third parties, and we don't publish them outside the app.

Every photo goes through automated review before it becomes visible. When you upload it, it sits in a pending state; an automated image moderation system analyses it and only then is it approved or rejected. The threshold is strict on purpose. If a photo is rejected you can upload another one: rejecting an image does not penalise the account.

Chat images follow a different, tighter path. They go to private storage, never to a public address; they're moderated before delivery; they arrive blurred and the other person decides whether to open them; and they're really deleted when a match is undone or when you delete your account. There's also a limit on how many you can send per conversation per hour, because without one the channel becomes a harassment tool.

We may remove any content that breaks the rules, without prior notice when the seriousness calls for it.

The verification badge

Verifying is optional. It means taking a selfie that gets compared against your profile photo to check that you're the person in it.

All the badge says is exactly that: the face in the photos matches the face of whoever controls the account. It is not an identity check, not a background check, and not a guarantee that the person is trustworthy. Don't lower your guard because someone has a badge.

There's a limited number of attempts per day. The selfie is not kept: it is deleted from the server as soon as the comparison finishes, whether it passes or fails.

What we are not

We don't introduce anyone and we don't vouch for anyone. Vexxy provides the channel; the people on the other side are strangers and should be treated as such.

We don't run criminal background checks and we don't verify anyone's legal identity. If you meet up with someone, do it somewhere public, tell someone you trust, and make your own way home.

Suspension and removal

We may limit, suspend or close an account that breaks these terms or the house rules. Depending on the seriousness, that ranges from taking down one photo to a permanent ban.

Some things have no scale: a suspected minor, credible threats, and sexual content involving people who didn't consent lead to immediate removal and, where it applies, to law enforcement.

A removed account stops appearing to others and stops being able to write.

Every suspension has a reason and an end date, and lifts itself when that date arrives. The only ones with no end date are the irreversible cases just listed.

Part of this is automated, and you should know it. The system keeps an internal assessment of every account and can, on its own, put one under review or suspend it. Automatic suspension is reserved for the unequivocal; everything doubtful goes to the review queue, where a person looks at it and nothing is restricted in the meantime. On top of that, every suspension automatically opens a human review, including the ones we apply by hand. You can ask for a person to review the decision, put your side of it, and contest it: write to us. The detail is in the privacy policy, under "Automated decisions about your account".

Don't open another account to get around a suspension. That's a breach on its own. To detect it we use a device fingerprint, explained in the privacy policy. A device having a history doesn't get anyone removed — phones get inherited, sold and shared — what it does is put that account under review so a person can look at it.

Deleting your account

You can delete it at any time from Settings → Delete account, and also from a public web page without opening the app.

Deletion is real and there's no undo: your profile, your photos, your swipes, your matches, your messages and any images you sent are removed. Storage files are deleted first and the database row second, in that order, because the other way round we'd lose the record of which files needed deleting.

The only things kept are what exists as evidence in an open report, and what the law requires us to keep.

Money

Vexxy works in full without paying anything, and it carries no advertising.

On top of that there's Vexxy Plus, an optional subscription that adds four things: seeing the list of who liked you, unlimited undos, likes with no daily cap, and filtering the deck by interests.

No feature that already existed has moved behind the paywall. Chat, matches, the discovery filters and verification stay free and complete. What the free version does have are daily caps on likes and undos, there to slow down spam and automated swiping; Plus lifts them.

It's sold in 1, 3 and 12 month terms. The price you see is the one the store shows you, in your currency and with your country's tax: we don't write it, and that's why it isn't in this document.

Google Play handles the purchase

The payment is a contract between you and Google, not between you and us. The subscription is bought from inside the app, but the one who charges you, holds your payment method and sends you the receipt is Google Play. We never see or handle your card details. The only thing Google tells us is whether your subscription is live and until when.

It renews itself. At the end of each term the next one is charged automatically, at whatever the price is then, and it keeps going until you cancel. This is also stated on the purchase screen, before you pay.

Cancelling happens in Google Play, not in the app. The path is Google Play → Menu → Payments and subscriptions → Subscriptions → Vexxy. Vexxy has a shortcut that takes you to that screen, but the cancellation happens there. And watch out for this one: uninstalling the app does not cancel the subscription, and deleting your Vexxy account doesn't either — deleting the account destroys your data, but the charge lives with Google and only Google can stop it.

Cancelling doesn't refund the term you're in. What it does is switch off renewal: you keep Vexxy Plus until the date you'd already paid for, and after that you go back to the free version without losing anything in your account or your conversations.

Refunds are handled by Google, through its own process and under the Google Play refund policy. We can't refund money on our own account that we never charged. Write to us anyway if something goes wrong: we can check what state the subscription is in and tell you what to ask for and where.

Right of withdrawal

Vexxy Plus is digital content that starts being delivered the moment you buy it: all four extras switch on immediately, not the next day.

Where the law of your country gives you a period to withdraw from a distance purchase, confirming the payment is you expressly asking for the service to start right away, and accepting that you lose that period once it has started. That's the usual exception for digital content delivered immediately.

Two things this doesn't touch: the Google Play refund policy, which runs on its own and stays available, and any right the law of your country doesn't let you waive.

The service is provided as is

We do our best to keep Vexxy working, but we don't guarantee it will always be available, or bug-free, or that automated moderation will always get it right. It can change, and it can stop existing.

To the extent the law allows, we're not responsible for what other people do or fail to do, inside or outside the app.

Changes to these terms

If they change in a meaningful way, we'll tell you inside the app before the change takes effect. Continuing to use Vexxy after that means accepting them.
